ASIC

During a recent review ASIC identified a technical error in the application of indexation to certain company review fees since 2011.

The affected fees included late fees, 10-year upfront fees and special company review fees under the Corporations (Review Fees) Regulations 2003.

This review identified a discrepancy between the original policy intention of the regulations and the wording contained in the actual enacted regulations.

This discrepancy meant that while ASIC has been applying the fees as originally intended, they did not reflect the regulations.

The Government updated the regulations on Tuesday 12 March to reflect ASIC's application of the fees and the intended policy outcome.

Users of ASIC's services do not need to take any action because of this update.
