The Building Services Board has fined a Midland builder $5,000 after he allowed a business to include his registration details on contracts for projects that he was not involved with.
At its July meeting, the Board found that Nermin Nezic - who is a registered building practitioner (BP101766) and a registered building contractor (BC101476) - engaged in misleading conduct under WA's building registration laws.
The Board was told that in 2018, a company called WA House Flippers Pty Ltd (now in administration) entered into two building contracts to supply and install transportable homes in Pingelly and Maida Vale.
Despite Mr Nezic's details appearing in the supervisor's section of each contract, he was not in fact involved with either project.
During an investigation by Building and Energy, Mr Nezic admitted that he had given House Flippers permission to use his registration details but he said he had not intended to mislead anyone.
He told investigators he had expected to be House Flippers' nominated supervisor if it became a registered building contractor. However, the business had not applied for this registration before it went into administration.
Building and Energy Executive Director Saj Abdoolakhan said although Mr Nezic was remorseful and cooperative, the misuse of his details had misled the consumers involved.
"The clients entered into contracts with the belief that a registered builder would be supervising the construction work, when this was not the case," he said.
"These 'licence lending' practices are illegal under building legislation and undermine the integrity of the building registration system, with potential impacts on community safety and confidence."
