Mitchell Shire Council issued Boogie 13 Festival two Planning Infringement Notices and more than $3,200 in fines following their Easter long weekend event in Tallarook.
Authorised Officers were onsite during the event, which ran from 19 April until 22 April at 210 Tallarook-Pyalong Road, Tallarook, and handled a number of complaints.
Council engaged an accredited noise monitoring expert to measure noise and decibel readings during the event. The evaluator concluded that the noise from the event did not breach the Environmental Protection Agency's guidelines.
However, the noise monitoring expert determined that noise was heard by neighbouring properties during the night which was in breach of the Planning Permit issued by Mitchell Shire Council.
Event organisers were issued Planning Infringement notices for:
- Music was heard at residences between 10pm and 12pm which is not permitted
- An outdoor stage operated outside of its approved time slot
Council fined the event's organisers more than $3,200 - which has been paid.
The information collected from strategic points around the event helped provide critical information for Council to consider enforcement action.
This is the first time Council has undertaken enforcement action against the event. Any future breaches to their planning permit may result in further enforcement action.
Council will now work with the operators of the festival to ensure conditions are met for all parties.
