Building and Energy is advising property owners affected by the liquidation of Flexible Homes Pty Ltd to contact their home indemnity insurance (HII) provider, QBE Insurance.
The Perth building company appointed liquidators yesterday (27 June 2023). Building and Energy understands Flexible Homes was directly contracted for 19 building projects.
Building and Energy Executive Director Saj Abdoolakhan said people with contracts and HII policies with Flexible Homes should contact QBE on 1300 790 723 to discuss arrangements.
"This enables home owners to begin the process of engaging another registered builder to complete the work or managing other remedies they may be entitled to," Mr Abdoolakhan said.
"In cases where Flexible Homes has managed and supervised a project, but the building contract is with another builder, home owners should contact the builder named on the building permit to discuss arrangements for the completion of their homes.
"These home owners can continue to pursue remedies for any losses they may suffer under the home building contract despite Flexible Homes' liquidation."
Building and Energy has been investigating concerns about Flexible Homes' building projects and contracting practices. The regulator is now evaluating options for this investigation following the company's liquidation. Building and Energy can also take action against other building contractors if they are found to have engaged in improper conduct.
Under new security of payments laws, the Building Services Board has increased powers to exclude officers of registered builders that do not pay their debts to contractors or have a history of financial failure. This includes exclusion from starting or continuing a building services business.
