HSU Wins Injunction Against Asmar's Union Resource Use

The Health Services Union (HSU) has secured a significant legal victory in the Federal Court, obtaining an injunction that prevents Health Workers Union (HWU) Victoria Branch Secretary Diana Asmar and her fellow HWU officials, from using union resources to fund their legal defence. The HSU sought the injunction after learning of the serious allegations contained in the proceedings, initiated by the Fair Work Commission, prosecuting Diana Asmar, her husband David, and five other individuals from the HWU Victoria Branch.

The allegations involve serious contraventions of the Fair Work (Registered Organisations) Act 2009, including claims that Ms Asmar approved payment of more than $2.7 million to a printing business and received cash back, as well as allegations of $120,000 in purported financial reimbursements to Ms Asmar without evidence of relevant business expenses. HSU National Secretary Lloyd Williams hailed the court's decision as a crucial step in protecting members' interests: "This injunction is a significant victory for the members of the HWU Victorian Branch, and the broader Union. It ensures that hard-earned union dues cannot be misused to defend individuals facing serious allegations of misconduct. Our priority has always been, and remains, safeguarding our members' resources and trust." The injunction reinforces the HSU National Executive's commitment to accountability and transparency. It follows its unanimous decision to apply to the Federal Court to place the Victorian HWU Branch into administration, citing its inability to function effectively under its current leadership. "Today's court ruling vindicates our proactive approach in addressing these serious issues," Williams added. "It sends a clear message that the HSU will take concrete action to protect members' interests and maintain the integrity of our union." Allegations against the HWU Victorian Branch are confined to that branch of the Union. The Fair Work Commission has explicitly recognised the HSU National Executive's efforts to address the problem and restore full integrity to the Victorian Health Workers Union Branch and ensure it refocuses on serving its hardworking and dedicated members. The HSU reiterates its zero-tolerance policy for any misuse of members' funds.
