An Iraq-born man has been charged with allegedly failing to comply with his visa-mandated curfew conditions.
The man, 34, was charged by the AFP in Melbourne yesterday (20 February 2025) after he was arrested on other matters by Victoria Police.
He was granted bail to appear at the Melbourne Magistrates Court on 3 April 2025.
The AFP will allege the man breached the conditions of his Commonwealth visa on nine occasions between 21 January 2025 and 16 February 2025, by failing to observe his residential curfew obligations.
It will also be alleged the man breached the conditions of his Commonwealth visa by failing to maintain his electronic monitoring device.
The AFP charged the man with;
- One count of failing to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958 (Cth), and;
- One count of failing to comply with a requirement to ensure his monitoring device remains in good working order, contrary to section 76D(3) of the Migration Act 1958 (Cth).
Both offences carry a maximum penalty of five years' imprisonment and/or a $93,900 fine.
