NDIS Supports Consultation Opens

On 27 March 2024, the Australian Government introduced proposed changes to the NDIS Act to set up the scaffolding needed to start making the NDIS stronger and to improve outcomes for NDIS participants.

The NDIS continues to be life-changing for thousands of Australians. But we know that for others, it's not working as well as it could and should be.  

We're focused on making sure participants have a better experience and the Scheme is there for the future.  

As part of the proposed legislative amendments to Section 10 of the NDIS Act, Government has developed draft definitions of NDIS Supports which describe what NDIS funding can and cannot be spent on.

The draft definitions clearly describe appropriate uses of NDIS funding under the Act, and reflect current guidance and practice.

If passed by the Australian Parliament, the proposed amendments to Section 10 of the NDIS Act 2013 will create a power to make a new rule which outlines what is and is not an NDIS support.

The new rule must be agreed by the Australian Government and all states and territories. It will take time to develop.

Development will be informed by engagement and consultation with participants and the disability community.

While this work is undertaken, a transitional rule must be in place to operate while the longer-term rule is developed and agreed.

The draft definitions, informed by consultation with the disability community, will form the basis of the transitional rule.

The transitional rule will operate until the longer-term rule can be agreed.

Nothing is changing right now. Participants should continue to spend in accordance with their plans, in line with current guidance, as they have been doing.
