Peninsula Projects Halted Over Illegal Deposit Scandal

A Mornington Peninsula building company has been ordered to immediately stop operating after the Supreme Court granted the Victorian Building Authority (VBA) an injunction today.

Peninsula Building Projects Pty Ltd based in Rosebud, is an unregistered company claiming to specialise in bathroom, kitchen and home renovations and new builds.

The Supreme Court injunction prevents the company and its director Clancy John (CJ) Fulton from carrying out any business as a builder.

This includes providing quotes for proposed work, entering into contracts, rendering invoices, accepting money or being in any way involved in the promotion or establishment of a building business.

The Court has also accepted an undertaking from CJ's sister Teresa Katrina Fulton Young that she and her company PBP Peninsula Building Projects Pty Ltd will not carry out any business as a builder except in her capacity as an employee of an interior design company.

The VBA alleges Peninsula Building Projects Pty Ltd is falsely using the registration of another builder and has taken deposits well in excess of the maximum allowed before work starts.

The court was told deposits were paid ahead of the build starting or during construction, then work stopped and the company became uncontactable.

A statement provided to the court detailed how one consumer handed over $100,000 to renovate a master bedroom and ensuite with the builder leaving after demolition and failing to complete the work.

The VBA believes Peninsula Building Projects could potentially have dealt with up to 100 consumers.

The case is scheduled to return to court in January.

Quotes attributable to VBA Commissioner and Chief Executive Officer Anna Cronin

"Always check your builder is registered for jobs over $10,000 – no matter how slick a website they may have."

"This case shows the importance of checking the credentials of a builder are genuine on the VBA website before hiring them."
