Secretary General Backs Authority of Constitutional Court of Bosnia and Herzegovina

Council of Europe Secretary General Marija Pejčinović Burić today made the following statement:

"I strongly condemn the adoption of the Law on the non-application of decisions of the Constitutional Court of Bosnia and Herzegovina in Republika Srpska by the National Assembly of Republika Srpska. The decisions of the Constitutional Court of Bosnia and Herzegovina are final and legally binding on its whole territory. Such attempts to undermine the constitutional and legal order of the country, contrary to the fundamental principles of the rule of law, are not acceptable.

"The Council of Europe supports the authority of the Constitutional Court of Bosnia and Herzegovina. It remains an institutional guarantor for the protection of human rights and rule of law in the country, as confirmed in the judgments of the European Court of Human Rights. Legal certainty must be ensured for all citizens of Bosnia and Herzegovina. The Council of Europe will continue to assist and support Bosnia and Herzegovina in implementing its reform agenda, aimed at strengthening human rights, democracy and the rule of law."
