Sudan-born Man Charged With Visa Breach In NSW

A Sudan-born man is expected to appear before Parramatta Local Court today (19 February, 2025), charged with allegedly failing to comply with his visa-mandated curfew conditions.

The man, 37, was arrested yesterday (18 February, 2025) after he was located in Sydney.

It will be alleged the man breached the conditions of his Commonwealth visa between 4 January, 2025, and 18 February, 2025, by failing to maintain his electronic monitoring device.

The man has been charged with:

  • One count of failing to comply with his visa-mandated conditions relating to maintaining an electronic monitoring device, contrary to section 76D(3) of the Migration Act  (Cth). This offence carries a maximum penalty of five years' imprisonment and/or a $93,900 fine.  

  • One count of failing to comply with his visa-mandated conditions, relating to wearing an electronic monitoring device, contrary to section 76D(1) of the Migration Act (Cth). This offence carries a maximum penalty of five years' imprisonment and/or a $93,900 fine.  

  • One count of possess identity documents with the intention of committing an indictable offence, contrary to section 192K of the Crimes Act 1900 (NSW). This offence carries a maximum penalty of seven years' imprisonment.
