Sudanese Man Charged With Seven Visa Breaches

A Sudanese man is set to appear before the Melbourne Magistrates' Court today (16 August, 2024) charged with allegedly failing to comply with his visa-mandated curfew conditions.

The AFP charged the man, 37, on 15 August, 2024, after he was arrested in Melbourne, Victoria.

It will be alleged the man breached seven of the conditions of his Commonwealth visa by failing to observe his residential curfew obligations, failing to maintain his monitoring device and failing to comply with a direction to not go within 200 metres of a school.

The man has been charged with:

  • Three counts of failing to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958 (Cth);
  • Three counts of failing to comply with a direction not to go within 200 metres of a school contrary to section 76 (DAB) subsection 1 of the Migration Act 1958 (Cth); and
  • One count of failing to maintain a monitoring device, contrary to section 76D of the Migration Act 1958 (Cth).

These offences carry a maximum penalty of five years' imprisonment and a $93,900 fine for each offence.
