As we shared with the community in early August, Hume City Council has commenced enforcement proceedings in the Victorian Civil and Administrative Tribunal (VCAT) in relation to ongoing earthworks being undertaken in contravention of the Hume Planning Scheme on land at 370A and 430 Riddell Road, Sunbury.
On 19 December Council's VCAT action was the subject of an Administrative Mention. That Mention confirmed that the matter had not yet been resolved and is proceeding to a full Hearing listed for 11-13 March 2025. Council sought no further procedural orders at the mention.
A Respondent to the proceeding advised VCAT and Council that the required Erosion Management Plan (EMP) is being prepared professionally and will not be ready for submission until late January 2025. VCAT advised that a second Administrative Mention will be called in February (no date set yet) for that EMP to be discussed in response to VCATs original Tribunal Order.
All works and development across the land have ceased and continue to be monitored by Council.
